Delyra Terms of Use

These terms apply between you and GamaVirtual Internet Ltda (“GamaJogos”, “we”, “us”), Brazilian company number (CNPJ) 10.442.661/0001-20, for the use of the game Delyra (the “Game”) on Android and on the web. By playing, you agree to them. Please also read the Privacy Policy. This English version is provided for convenience; if the versions differ, the Portuguese version prevails, except where the law of your country requires otherwise.

#1. Who can play

The Game is designed for people aged 13 and over. If you are under 18, use the Game with the knowledge of your parent or guardian, who also accepts these terms on your behalf.

#2. Licence

We grant you a personal, free, non-exclusive, non-transferable and revocable licence to install and play Delyra for fun, for non-commercial purposes. The Game, its levels, art, Lumi, texts, sounds and the Delyra brand belong to GamaJogos or its licensors and are protected by law. You may not copy, sell, rent or redistribute the Game or any part of it.

#3. Crystals, stars and in-game items

Crystals, stars, items, relics, achievements and other rewards exist only inside the Game: they have no monetary value, are not your property, cannot be exchanged for money, sold or transferred to anyone else, and are not refundable. The Game does not sell currency or items. We may adjust amounts, costs and rewards to keep the Game balanced. If you do not use “Save to cloud”, progress is kept only on your device and may be lost when you uninstall the Game, clear its data or change devices.

#4. Ads

The Game is free and shows ads. For rewarded ads, the reward is only given when the ad is watched to the end. Ads come from third parties: the advertiser is responsible for what is advertised. If you see an inappropriate ad, please tell us.

#5. Fair play

You may not:

• use cheats, third-party programs, bots or modified versions of the Game;
• deliberately exploit bugs to gain an advantage (for example, in the Guardian number) or fail to report them to us;
• generate artificial ad views or clicks;
• reverse engineer the Game, except where the law allows it;
• try to access other players’ data or disrupt the online services.

If this happens, we may disconnect the cloud account, remove records obtained improperly (such as a Guardian number) or block access to the online services, without prejudice to any legal measures.

#6. Online services and changes to the Game

Cloud save, Guardian number, Daily Enigma, Google Play Games achievements, remote configuration and ads depend on the internet and on third-party services (mainly Google). They may change, be unavailable or be discontinued. Where possible, we will give reasonable notice in the Game. The Game may also be updated, with changes to levels, rules and features. The Guardian number is symbolic and grants no rights outside the Game.

#7. Liability

We work to keep the Game running well, but we do not guarantee that it will work without interruptions or errors on every device. To the extent permitted by law, we are not liable for loss of progress caused by uninstalling, clearing data, changing devices without “Save to cloud” or failures of third-party services. Nothing in these terms limits the rights that the Brazilian Consumer Protection Code or the law of your country gives you and that cannot be waived by contract.

#8. Google Play and Google

Downloads from Google Play are subject to the Google Play Terms of Service. Sign-in with Google and Google Play Games are subject to Google’s terms. Google is not a party to these terms.

#9. Ending and changes

You can stop playing at any time and delete your cloud account (see how). We may change these terms when the Game or the law changes; for material changes, we will notify you in the Game before they take effect. Continuing to play after that means you accept the new terms.

#10. Governing law and courts

These terms are governed by the laws of Brazil. If you are a consumer in Brazil, you may bring a claim in the courts of your domicile (Consumer Protection Code, art. 101, I). Otherwise, the courts of Várzea Paulista/SP, Brazil, have jurisdiction. If you live outside Brazil, you keep the protection of the mandatory consumer laws of your country of residence.
